What are the fees for a criminal lawyer?

According to the relevant government documents, criminal lawyers' fees are divided into the following two categories:

二、Piece charge - charge by stage

1. Criminal prosecution cases: the investigation stage, the review and prosecution stage, and the trial stage (the first instance, the second instance, the death penalty review, the retrial, and the appeal are all regarded as an independent stage). Each stage is charged separately.

2. Criminal private prosecution cases: the charges will be charged by the first instance, the second instance, the retrial and the appeal stage.

3. If defense lawyers also represent criminal cases with civil lawsuits, the civil part will be charged separately.

4. If a criminal suspect or defendant is suspected of committing more than two (including this number) crimes or two or more (including this number) criminal facts at the same time, lawyers’ service fees may be charged separately according to the number of crimes involved or the number of criminal facts.

5. The following cases are agreed upon by the law firm and the client, and can be charged at not more than 5 times the prescribed charging standard:

(1) First-instance cases under the jurisdiction of people's courts at or above the intermediate level (including intermediate-level), retrial cases accepted by courts at or above the provincial level (including provincial-level), and protest cases brought by the procuratorate;

(2) The case is complex, and the lawyer's time to handle the case is significantly longer than that of similar cases;

(3) The case involves difficult professional issues, and the requirements for the professional level of lawyers are significantly higher than those of similar cases;

(4) The case is handled in a different place, and the lawyer's time to handle the case is significantly longer than that of similar cases;

(5) Cases that meet the standards of major, difficult and complicated cases in courts, procuratorates, public security, judicial administration and other organs;

(6) Cases with significant social impact;

(7) Major foreign-related cases.

 

Legal fees, arbitration fees, appraisal fees, notarization fees, file checking fees, translation fees, travel expenses for handling cases in different places, cross-border communication fees, expert argumentation fees, and legal fees paid by law firms on behalf of clients in the process of providing legal services Other fees paid by the client (hereinafter collectively referred to as "case handling fees") are not fees for lawyers' services and shall be paid by the client separately. The handling fee shall be agreed between the law firm and the client in the entrustment contract. The case handling fee shall be used reasonably according to the purpose stipulated in the contract. After the entrusted matter is completed, the two parties shall settle the settlement according to the contract.
